Terms and Conditions

These DIGICEL“Gaz Kole” Summer Promotion (the “Promotion”) terms and conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win a prize (GRAND PRIZE) at the end of the promotion. You should read these Terms carefully before participating in the Promotion.

“We” or “us” means Unigestion Holding S.A. (« Digicel Haïti »), a company registered under the laws of Haïti with registered offices at # 151, Av. Jean Paul II & Impasse Duverger, Turgeau, Port-au-Prince, Haïti. References to “we”, “our” and “us” in these Terms includes our subsidiaries and affiliates (“Affiliates”) from time to time.

“I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

"Draw Participant" means any natural person registered for the Grand Draw. 

By participating in the Promotion, you agree to be bound by these Terms.

1. What is the Digicel “Gaz Kole” Summer Promotion?                              

The Digicel “Gaz Kole” Summer Promotion (the “Promotion”) allow eligible customers to receive entries in our summer Grand Draw Raffle (“The Raffle”) for a chance to win a Grand Prize. 

• What is the promotional period for the promotion

The Promotion starts on July 1, 2024, and ends on September 1, 2024 (the “Promotional Period”).

• What is the Grand Draw Raffle?

The Grand Draw Raffle is a raffle that will be held on September 1st, 2024. Participants can win entries into the Grand Draw Raffle by completing a Qualified Activity.

• How to earn Entries into the Grand Draw Raffle?

• Each gourde spent when purchasing a Digicel Prepaid plan will count as one point or entry into the Grand Draw Raffle.
• The customer with the most points at the end of the promotional period will have the most entries into the raffle, thereby increasing their chances of winning the Grand Prize.

• What activities qualify me to participate in the Promotion?

Purchase any Digicel Prepaid plan to gain an entry into the Grand Draw Raffle and participate in the promotion.

• Who is eligible to participate in the Promotion?

The following people are eligible to participate in the Promotion:

1. Digicel GSM (Mobile) prepaid customers

• What is the Grand Prize?

The Grand Draw Raffle Winner will win a Toyota Agya Car.

• What do I need to know about redeeming my Raffle prize?

If you have won the Grand Prize Raffle, follow the instructions of the Digicel representative who will contact you to redeem your prize.

• Who cannot participate in the Promotion?

Postpaid Corporate & Business account customers;

• Can I participate in the Promotion while roaming?

This Promotion is not accessible while roaming.

1. What will the winner need to present in order to redeem his/her prize?

The winner must present a valid Government issued photo ID (passport, voter’s identification card or driver’s licence) and the phone used to participate in the Promotion. The winner will be required to complete and sign a redemption form confirming receipt of the prize and a Consent and Release Form authorizing the use of his/her picture on Social Media.

Additional Terms and Conditions

1. This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion. 
   
   
2. We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.
3.  You are solely responsible for all associated fees and costs incurred by you for redemption of prizes and for connectivity and data usage in relation to your use of the App. 
4. The selected winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes. 
5. Warranty and support information will be included in product packaging.
6. We reserve the right to modify, extend or discontinue (permanently or temporarily), this Promotion being offered to you at our discretion.
7. If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize of equal value and/or specification.
8. Except where the choice is given to trade, prizes are not exchangeable and are not redeemable for cash.
9. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.
10. Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or by any agent or sub-processor duly appointed by Digicel to assist with mechanics, management, advertising, marketing, execution or any other operation of the Promotion, for and on behalf of Digicel and will not be disclosed to any other third party for any other purpose. 
11. By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent or sub-processor appointed by Digicel to carry out the Promotion. You further consent to Digicel's disclosure, use and publication of your name, nickname, image, voice, caricature, endorsement, signature, initials, reputation, autograph, address, country of birth and domicile, biographical data and/or likeness in connection with the exploitation, exhibition, distribution, advertising, publicity and promotion of the Promotion and the Digicel brand in all media, whether now known or hereafter devised, throughout the universe, perpetually and without restriction. 12. Winners may share their winnings on their social media platforms and may be required to take part in related publicity, including (without limitation) publication of the name and image of a winner along with their winning entry via Digicel’s website, social media and other press and media channels. No payment will be given for this.
13. Except in the event of its negligence, neither Digicel, nor any other person or party associated with the Promotion, their associated companies, agents, contractors and sponsors or any of its personnel involved in the Promotion, shall be liable whatsoever for any loss or damage incurred or suffered, death or personal injury suffered or sustained, or costs incurred, arising from either participation in the Promotion or from claiming any reward.
14. In addition to these Terms and Conditions, you remain bound by our MyDigicel App Terms and Conditions of Use.
